Terms of Service

1. Acceptance of Terms

By accessing or using the Zanzai platform ("Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Zanzai provides a business listing platform with AI-powered chat assistants for small businesses. Business owners can create listings, manage services, and engage with customers through AI chat.

3. User Accounts

You must provide accurate information when creating an account. You are responsible for maintaining the security of your account credentials. You must be at least 18 years old to use this Service.

4. Business Listings & Seller Responsibility

You — the business owner — are solely responsible for everything you publish on your listing, including business name, address, phone number, WhatsApp number, public email, booking link, services, prices, operating hours, photos, logo, bio, FAQs, and any other content you upload or provide to the AI assistant. You represent that you have the right to publish this information and that it is accurate.

Because contact details such as phone numbers and email addresses on your listing are publicly visible, you accept the consequences of disclosing them. Zanzai is not responsible for unsolicited contact, spam, scraping, scams, harassment, fraud, or any other misuse of contact information you choose to publish.

Zanzai is not responsible for losses, missed bookings, customer disputes, regulatory consequences, or any other harm arising from incorrect, outdated, or misleading information you publish on your listing. If a customer relies on your listing and the information is wrong, that is your responsibility, not ours.

Zanzai reserves the right (but is under no obligation) to remove, suspend, or disable listings that we believe contain false, misleading, abusive, illegal, or otherwise inappropriate content, or that violate these terms.

5. AI Chat Assistant & AI-Generated Content

The AI chat assistant generates automated responses to customer questions based on the information you provide about your business. The platform may also offer AI-assisted content suggestions to sellers (for example, suggested service descriptions or bio drafts).

AI output is generated automatically and may be inaccurate, incomplete, outdated, or misleading. AI-generated text does not constitute legal, medical, financial, professional, or any other form of expert advice. You must review every AI suggestion before publishing it, and you remain responsible for any content you accept and publish on your listing or send to your customers.

Zanzai is not liable for AI-generated answers, AI-generated content suggestions, hallucinations, factual errors, omissions, missed bookings, lost revenue, customer disputes, or any other harm arising from the AI assistant or AI suggestions. The AI is a tool to help you serve customers — it is not a guarantee of accuracy and it does not replace your judgment.

Chat messages are stored and may be reviewed by the business owner.

6. Chat User Consent

By using the chat feature on any business listing, you acknowledge that your messages are stored, processed by our AI provider, and made available to the business owner. Your contact information (name, phone number, email) may be captured when voluntarily provided during the conversation. AI responses are automated and may be inaccurate — do not rely on them for medical, legal, financial, or other professional advice.

7. Payments & Subscriptions

Paid plans are billed by Stripe on a recurring subscription basis (monthly or annual, depending on the plan you choose). By starting a paid subscription you authorise Zanzai, via Stripe, to charge your payment method on each renewal until you cancel.

You may cancel your subscription at any time from your account page. Cancellation takes effect at the end of your current billing period — you keep paid features until that period ends, and we do not pro-rate refunds for unused time.

If a payment fails, your account enters a short past-due grace period. If payment is not resolved before the grace period ends, paid features are downgraded to the free plan. Your data is not deleted as a result of a downgrade.

Prices, plans, and feature limits may change. We will give registered users reasonable advance notice of price increases that affect them. Continued use of a paid plan after a notified price change constitutes acceptance.

8. Data Processing & Sub-processors

The Service relies on a number of third-party sub-processors, including Stripe (payments), Google (OAuth, Places, Maps), an AI provider, a cloud hosting and serverless compute provider, a managed Postgres database provider, a cloud object-storage provider, a transactional email delivery service, an in-memory cache provider, and a product analytics provider. Data is processed and stored on cloud infrastructure based in the United States and the European Union. 9. Acceptable Use

You agree not to use the Service to: upload illegal, harmful, or offensive content; impersonate another business or person; publish information you do not have the right to publish; attempt to gain unauthorised access to other accounts or systems; scrape, harvest, or resell platform data; send spam or unsolicited messages; or violate any applicable laws.

10. Intellectual Property

Content you upload (photos, business information, bios) remains yours. By uploading content, you grant Zanzai a worldwide, non-exclusive, royalty-free licence to host, display, reproduce, and distribute it for the purpose of operating and promoting the Service. The Zanzai platform, branding, and technology are the property of Zanzai.

11. Disclaimers & Limitation of Liability

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, or uninterrupted availability.

To the maximum extent permitted by law, Zanzai is not liable for, and disclaims all responsibility for:

  • Any AI-generated content, including chat responses and AI-suggested listing content, regardless of whether the output is inaccurate, incomplete, misleading, or harmful.
  • The accuracy, completeness, or lawfulness of information you publish on your listing.
  • Misuse of contact details (phone, email, WhatsApp, address, booking link) you choose to make publicly visible — including spam, scams, fraud, harassment, or scraping.
  • Lost revenue, missed bookings, customer disputes, or reputational harm arising from your listing or from AI output.
  • Acts or omissions of other users, customers, or third-party sub-processors.
  • Service interruptions, data loss, or downtime caused by sub-processors or events outside our reasonable control.

Our total aggregate liability to you for any claim arising out of or relating to the Service is limited to the fees you have actually paid to Zanzai in the twelve (12) months preceding the event giving rise to the claim, or USD 100, whichever is greater. Nothing in these terms excludes liability that cannot be excluded under applicable law.

12. Indemnity

You agree to indemnify and hold Zanzai harmless from any claim, demand, loss, or damages (including reasonable legal fees) arising from: content you publish on your listing, your use of AI-suggested content, your misrepresentation of your business, your violation of these terms, or your infringement of any third-party right.

13. Termination

You may delete your account at any time from your account page. Zanzai may suspend or terminate accounts that violate these terms or that we reasonably believe are abusive, fraudulent, or harmful. Upon deletion or termination, your data is permanently deleted immediately — there is no recovery period and no post-deletion export window. If you want a copy of your data, request it before you delete your account.

14. Changes to Terms

We may update these terms from time to time. Continued use of the Service after changes constitutes acceptance. We will notify registered users of material changes via email.

15. Governing Law

These terms are governed by the laws of the jurisdiction in which Zanzai is incorporated (currently the Republic of South Africa). Nothing in these terms affects mandatory consumer protection rights you have under the laws of your country of residence.
